Would it be legal to create a SpongeBob SquarePants CCG if I got my own pictures drawn and didn't sell it?

If you also didn't distribute it, I don't think anyone would care. Arguably, once you start distributing it though, even if you're not selling it but taking credit for the creation, you are profiting in some manner through the distribution of the game (albeit perhaps not financially). You'd likely get a cease and desist order once the property owner became aware of it. It wouldn't matter that you'd get your own pictures created. If it can be identified as SpongeBob, it's SpongeBob whether its original or co-opted art.

There are of course legitimate uses of other people's intellectual property without permission (i.e. satire, political commentary, news coverage, reviews), but your post didn't contain anything that would suggest you'd fall into these categories.

Thanks for your help. :-) I don't think I'm gonna work on it anymore, but it's a good thing that I have a list of other CCGs that I could try to develop. One thing though; what if I did make SpongeBob CCG, scanned one of each card, and let people download them and print them (even though I probably won't)?

PS: I've never created a board game/CCG in my life (I just came here because I'm starting to get into it) so treat me like a newb lol. I think I'm gonna go get started on one of my other ideas Maximum Mech. Hopefully that works out...
