A friend and I are designing a game, but have come across an idea that we want to use. A very similar idea seems to already be in use for another published game. It is a pretty important game mechanic (for both our game and the other game) yet it could easily be contrived by a 3rd grader so I'm not sure if it could have legal protection in the form of a patent or whatever.
How would I find this out?
