Hello all

We have licensed our game to a US company which research shows has an excellent reputation. We have been paid advance royalties which have more than covered our costs. However, 18 months since signing the licence, the game is still not in production. Is this normal?

How many years is your contract for? If it was only 3 i might be worried. Depending on how complex the game is mechanically they might be having production issues that could have held it up. Even fairly simple games get hung up in this way. If it’s been more than 3 months since you have last asked I would contact the publisher and inquire how it’s going. After all you have a steak in it too. As long as you don’t pester them frequently its not inappropriate.

Hello temple. First of all, the fact that you ask us this question, and not your publisher, makes me wonder how your relationship is with that company. What's wrong with asking them? You have signed a contract with them, a professional agreement, so I don't think that asking them how things are going could be considered "pestering".

While a 18 month wait is long, I don't think it's all that unusual. There might be good reasons why it's taking them a long time to get all the stuff they need for the game. Again, just ask them what's wrong and why things are taking so long.

Finally, it should say in your contract how long they have to produce the game before the contract expires and the rights to the game revert back to you, so that you might try to get it published with another publisher.
